for and towards my daughter ANN L. SALMONS wife of
JOHN D. SALMONS have this day given and granted and by
these presents do hereby give and grant unto the said ANN L. SALMONS
for and during her natural life a certain female slave named
DILCY aged about thirty years and her children FOUNTAIN a boy
aged about thirteen years and MINERVA aged about seven
years free from the controle and exculsion of the two mariti(?) of
her said husband JOHN D. SALMONS or any other husband
which she may hereafter have and after her death to such
child or children as my said daughter ANN L. SALMONS
may leave living at the time of her death to them and their

12 Dec 1846 - Stokes County, Security Bond for Edwin H. Banner by Nancy R. Boyles who has authorized James T. Morehead to assign her name for Edwin H. Banner as adminstrator of the estate of Joshua Banner to a bond in Stokes County Court. Signed Nancy R. Boyles. Witness was W. M. Moore.

17 Dec 1846 - Administrative Bond of $20,000.00 to Edwin H. Banner in the right of Joshua Banner's estate. Signed Edwin H. Banner, John W. Banner, W. M. Moore, L. B. Banner, Elisha Banner and Nancy R. Boyles (signed for her by A. E. Banner).

17 Dec 1846 - Stokes County, James T. Morehead, attorney, petitioned the court saying that there are some 21 - 22 slaves which will have to be sold for the payment of debts and must be sold by July to avoid any sacrifice. The judge must order the slaves to be sold.

Dec 1846 - Stokes County Ex Parte to Edwin H. Banner to sell the slaves. It is ordered by the court that Reuben B. Golding, Trane Gibson and Marshall T. Benton be appointed commissioners to settle and report the term of Edwin H. Banner Adminstrator of Joshua Banner deceased estate and that in settlement the adminstrator be allowed 5 per cent commissions on the debit side and 21/2 cent on the credit side of account. Approved on the minutes, It is ordered by the court that Henry B. Lehman and William Gopling be appointed commissioners to settle with George F. Wilson and Zachariah Wall and wife Betsy, adminstrators with the will answer of Leonard Ziglar deceased and that they report to the May term of court. It is further ordered that the commissioners be allowed 5 per cent on the debit side of the account and 21/2 per cent on the credit side. TO BE CONTROLLED.

Dec 1846 - Stokes County, NC F. H. Shermer agent of the Cape Fear Bank at Salem took a judgement out on Martin L. Banner, Joshua Banner, and Lewis B. Banner for $260.00 which is owed by Joshua Banner, deceased. Also to make known to Edwin H. Banner to appear in court.

25 Dec 1846 - Stokes County,NC Antoinette L. Burtz takes a judgement out on Tandy Matthews, C. L. Banner and Edwin H. Banner, administrator of Joshua Banner, deceased's estate for $600.00 which they owe her with damages of $300.00.

Jan 1847 - Stokes County, NC Martha Banner's widows yearly allowance. John G. Hill appoints freeholders James S. Green, Joseph Smith, Harrison Hartman, Solomon Petree, William Tuttle, Frederick Morris, Jesse Fry, Matthew Crews, Henry Baker, Lewis Morris, J. L. Gibson and Jeremiah Gibson to allot 1/3 of the 661 acres of land. Land is located on both sides of Buffalo Creek. Laid off 106 acres including the dwelling house and all the offices, out houses, buildings and improvements.The freeholders valued Martha's 1/3 of Joshua's property at $1,498.00 making the total value of his land at $4,494.00.
NOTE: Martha's land was marked out for her as follows: Beginning at a STAKE at the ROAD thence running along the ROAD 48 poles to a stone thence south seventy degrees East 56 poles passing by TWO APPLE TREES to a DITCH thence south twelve degrees west along said DITCH 47 poles to BIRCHES on the NORTH BANK of the CREEK thence south eighty five degrees East 80 poles to the LANE near the BIG BARN thence south along said line twenty five degrees east passing through the GATE 10 poles to a STAKE thence north sixty six degrees east 40 poles to a BLACK OAK MARKED and thence north on a NEW LINE one hundred and sixteen poles to a small pine in GIBSON'S LINE west on the same168 poles to the BEGINNING containing 106 acres to be the same more or less.

9 Jan 1847 - Stokes County Court. Widow's allowance by freeholders Harman Miller, Jesse Fry, Peter Tuttle and M. L. Benton is as follows: 40 barrels of corn, 25 bushels of wheat, all the pork on hand, say about one thousand pounds, one cow and calf, one beef cow, all the sheep on hand, 12 head of hogs, two oak stacks,two hay stacks, three fodder stacks, all the shucks on hand, two bee stands, all the cotton and flax on hand, ten pounds wool robs and 4 bushels dried fruit and there being not sufficient of the crop. Stock and provisions on hand to make a comfortable year for the widow. Also $75.00 to be paid to the widow and family. court of Stokes made at December Term A.D. 1846 authorizing and requesting
me EDWIN H. BANNER admr. of the estate of JOSHUA BANNER decd. to make sale
of certain Slaves belonging to the said Estate and whereas in pursuance with
and by virtue of said decree and order I the Said E. H. BANNER admr. aforesaid
after due advertisement thereof according to law did cause one of the said
slaves, to wit, JEREMIAH a boy aged about Twenty Seven years to be put up
at auction on a credit of nine months at the late residence of Deceased
on the 11th day of January 1847 at which time and place C. H. NELSON by his friend
J. L. BITTING became the last and highest bidder at the sum of Five hundred
and Seventy dollars Therefore in consideration of the said sum of five hundred
and seventy dollars to me in hand paid by the said CONSTANTINE H. NELSON at and before
the Signing and Sealing & delivery of these presents to the receipt whereof I the
said E. H. BANNER do hereby acknowledgem have given granted bargained
and sold and delivered unto the said CONSTANTINE H. NELSON the said Negro
slave JEREMIAH To have and to hold to him the said CONSTANTINE H. NELSON
his heirs executors and administrators and I EDWIN H. BANNER admr. afore-
-said doth agree and bind myself to warrant and defend the right and title of
the said Negro JEREMIAH to him the said C. H. NELSON his heirs &c so far as

Banner Elk is in Avery County. Banner Elk's original name was Shawneehaw and the name was changed in 1911 to Banner Elk. The name comes from the Banner family and the Elk River.37

On the 1810 Stokes Co.,NC census there are 2 adults living in the home of Joshua, ages 26-45, one female and one male. This is thought to be Joshua's sister, Elizabeth and his brother, Henry. On the 1820 Stokes Co.,NC census is a male, age 16-26, living in the Joshua's home. This is thought to be Charles the step-brother of Joshua. In 1830, Charles,age 30-40, is still in Joshua's home along with Charles's new bride, age 20-30. By 1840, Charles and his wife are gone. It is not known what happened to Charles and his wife. He is not on an 1840 US census.13

On 15 Dec 1801 when Joshua was 21, he married Martha "Patty" BITTING, 2322, F, daughter of Anthony BITTING Sr., 2329, M (1738-1804) & Martha "Patty" POE/LEPEAU, 2330, F (1746-1788), in Stokes Co.,NC.10 Born on 17 Jun 1782 in Henry Co.,Va. Martha "Patty" died in Forsyth Co.,NC in Sep 1854; she was 72.

ten cents - and at Fall term of said Court, it appearing by the report of the Clerk
and Master that the purchase money had not been paid; It was ordered, adjudged &
decreed by the Court, that the Clerk & Master make title to the purchaser, when the
purchase Money shall be paid, and the same having this day been in full paid by JOHN

"I, Martha Banner, of the county of Forsyth
and the State of North Carolina being of sound
and perfect mind and memory blessed be God
but weak in body, I do this twelfth day
of March in the year of our Lord, one thousand
eight hundred and fifty four, make and
publish this my last will and testament.
In manner and form following, that is to say,
after paying all my just debts, I give and bequeath
to my DAUGHTER MARTHA BREEDLOVE and her heirs,
the tract of land whereon I now live including
the mantion[mansion] house and all improvements
thereon, containing Sixty-two acres. And I farther
give one bay mare, one wagon, one kettle, and
one walnut cupboard. Secondly, I give to my SON
M. R. BANNER one cow and one calf. Thirdly I give to
my DAUGHTER MARY B.CREWS one bed and
furniture,and one brass kettle. Fourthly I desire
that my negro man, Sam be sold together with
the balance of my property, to the highest bidder
on a credit of nine months, for the purpose of
paying my debts, and if there should be a surplus,
I wish it to be divided between ANTHONY E. BANNER,
JOSHUA D. BANNER, JOHN W. BANNER, MATTHEW R. BANNER,
LEWIS B. BANNER, MARTIN L. BANNER, EDWIN H. BANNER, and
MARY B. CREWS. Fiftly I appoint my
