Mar 1814 - Stokes Co., NC - Mary Davis guardian for Sally, Elizabeth and John Clayton* called "infants" - schooling and board was 28 pounds equal to $40.00. Signed by Sam Kinnaman, John Ledford and WIlliam Dobson, Clerk of Court. Another paper that said each ward is indebted ten pounds for board and maintenance. Signed by John Butner. *John Clayton was married in 1813.

On 30 Jun 1798 when Mary was 17, she married Nathaniel DAVIS, 4020, M, son of William DAVIS, 11038, M, in Stokes Co.,NC. Born ca 1777 in Stokes Co.,NC. Nathaniel died in Stokes Co,NC bef 1810; he was 33.

being weak in the body but perfect mind and
memory do constitute this my last will and
testamony in the manner and for following;
vis.
I give and bequeath to my beloved wife,
Elizabeth the house and land which I now
live on and all the negroes and stock of
every description during her natural life
or widowhood except each child is to have
a negro about the same age as they marry or
come of age and also a horse and cow and
bed and furniture And it is also my wish for
my sons all to have negro boys and my daugh-
ters negro girls if the negroes are not of
equal value, for them of the lowest value
to have some other property to make them
all equal. I do also appoint Richard FIynt

Petitioners were Levi Clinkscales and wife Ruth Clayton, Mary Clayton Davis, Elizabeth Clayton Flynt,
Richard Flynt and his wife Eleanor Clayton Flynt, James Garrett and his wife Charity Clayton Garrett.
About the lands of John Clayton(SR) deceased 1801. Charity Banner Clayton his wife has been dead for
some years, Martin Flynt husband of Elizabeth Clayton Flynt is now dead and Nathaniel Davis husband
of Mary Clayton Davis is now dead. When John Clayton died he had 8 tracts of land(inventory shows 7
tracts did not count perhaps tract received from Henry Banners estate?? Tract # 1. 296 acres adjoining
Benjamin Banner Tract # 2. 131 acres adjoining F.Bostick, Jeri Gibson and others, Mary Davis took as her
legacy.Tract # 3. 150 acres adjoining F.Bostick and others went to Stephen Clayton. Tract # 4. 203

Says that the heirs made a just division of lands some years ago(No date is given), according to the
nuncupative will of John Clayton(SR). The guardians sold the tracts of those children underage. The
150 acres that Stephen Clayton had was sold to John C. Blum for $402.00. John C. Blum then sold it

In the name of God amen. I John Clayton
do make this my last will & testament in the manner
following. to wit. I devise that my Burial &
Funeral expenses be paid together with all just
debts which I may be oweing at the time of my
death I further devise that my Executor proceed
to collect all debts that may be due me.
Having given my eldest DAUGHTER MARY L. MOORE
a negro girl name Phillis which since died which
I consider her loss with various articles of property
together with the sum of Three hundred &
fifty Dollars in money making her share
worth Eight hundred Dollars, further in as
much as I never made G. R. Moore a Bill
of Sale to a certain negro man named Lic
which I sold to him, I therefore consider him
the property of said Estate, he having accounted
to me for the same. Having given my SON
JOHN E. CLAYTON a like corresponding amount
to wit. Eight hundred Dollars. Having also
given my DAUGHTER ELIZABETH J. McANALLY a
negro girl named Cynthia together with her two
children Eveline & Alice making her share, equal
with those above named (Eight hundred Dollars)
Having paid my son John E. Clayton for the Land
that my SON REUBEN M. CLAYTON now holds a
deed for & other property & in addition I now give
a certain full piece of Land lying on the north
end of his home tract containing 33 acres more
or less. I give him Two hundred Dollars to
be paid by my Executor making his share equal
to those above named (Eight hundred Dollars
Having deeded to my SON WILLIAM F. CLAYTON
the Land he now lives on, & also other
property in value to those above named
(Eight hundred Dollars). Having deeded to
my SON MATTHEW C. CLAYTONa Tract of Land &
other property I now also will that my Executor
pay him the sum of Two hundred & fifty Dollars
in the division of my Estate. Having deeded
to my SON GABRIEL T. CLAYTON, a tract of Land
& other property I will that my Executor pay
him the sum of Two hundred & fifty Dolllars
in the division of my Estate. And not having
given my SON GIDEON T. CLAYTON any property I
now will that after my decease that he have my
home tract of Land containing 263
acres together with the improvements
therein believing it to be a greater value than
the shares above named I therefore will that
he refund to my estate the sum of Five hundred
Dollars. Not having given any property to my
DAUGHTER CHARITY E. CLAYTON I thereby give &
bequeath to her a negro girl named Ann, also
one Bureau one bed & furniture together with
one servicable horse saddle & bridle. All
other property not herein devised both real
& personal I devise shall be exposed to
public sale by my Executor on a reasonable
credit, after giving timely notice at such
time, as he may see proper for the
benefit of all parties concerned. I further

Research: John Clayton lived in Bethania Township on the old road[Great Wagon Road] leading from Oldtown[Bethabara] to Germanton. He had a log home on this land, which still stands today and predates 1816, possibly built by his father John Clayton/Charity Banner. This house was weatherboarded in 1860 and still stands, today as an antique shop.
John Clayton's son, Matthew Columbus, farmed and lived in this house after Matthew returned from the Civil War.

On 30 Aug 1816 when John was 27, he married Elizabeth MOORE, 4028, F, daughter of Reuben MOORE, 10392, M (1768-1817) & Mary Ann EDWARDS, 4029, F (-1807), in Stokes Co.,NC. Born on 8 Feb 1796 in Stokes Co.,NC. Elizabeth died in Forsyth Co.,NC on 11 Dec 1858; she was 62. Buried in Clayton Family Graveyard.

Elizabeth Jane first married Joseph Banner McANALLY, 4477, M, son of Charles McANALLY, 3973, M (1786-1844) & Sarah "Sally" BANNER (9), 3972, F (1788-1863). Born on 21 Oct 1822 in Stokes Co.,NC. Joseph Banner died in Stokes Co.,NC on 11 Apr 1852; he was 29. Buried in McAnally Cemetery,McAnally Plantation,Stokes Co.,NC.

In 1865 when Elizabeth Jane was 42, she second married William W. TERRY, 3993, M, son of John TERRY, 4004, M & Amney VAUGHN, 4005, F, in Forsyth Co.,NC. Born in 1805 in Stokes Co.,NC. William W. died in Forsyth Co.,NC in Sep 1879; he was 74.19 Near Sedge Garden.

"In the name of God, Amen. I William W. Terry of the County of Forsyth
in the State of North Carolina, do make, publish, and declare the
following to be my last will and testatment; that is to say .
First, I will and devise to my beloved WIFE ELIZABETH J. TERRY[Elizabeth Clayton] for and during her natural life, one third part in value of all my
lands of which I may die seized and possessed, including my dwelling
house and improvements, and I do also will and devise to her the
twenty five one acre tract part of which is known as the Zimmerman
tract, this I give to her absolutely.
Secondly, I wll and bequeath to my said wife ELIZABETH J.
TERRY all the money that may be on hand and debts due me at
my death, my grey mare, all the milk cows that may be on
hand, two beds, bedsteads, and furniture, her choice, one bureau
and contents, her chains, one clothes press and contents, the watch
she got of her brother Gideon Clayton, three band boxes and
their contents, and a large family bible which she had when
we were married.
Thirdly, I will and direct that my executors hereinafter named,
as soon after my death as may be convenient present to sell
the whole of the land of which I may die seized and possessed
including the remainder after my said wife's third part for her
life, that the sale be made for cash, at public auction, upon the
premises, after due advertisement, and that the proceeds of said
sale be divided as follows, to wit: to my SON NATHANIEL R. TERRY
one fourth part, to my DAUGHTER LORETTA TUTTLE WIFE OF PETER H. TUTTLE
one fourth part, to my DAUGHTER SARAH TERRY one fourth part,
and the remaining fourth part, I will and bequeath to the FOUR
LIVING CHILDREN OF MY SON JOHN H. TERRY, decd., late of the state of
GEORGIA, and to the survivors or survivors of them.
Fourthly, I will and direct that my executors hereinafter
named, as soon after my death as may be convenient, sell
at public aution, for cash, the whole of my personal estate, not
herein before disposed of, and the proceeds of such sale to dispose
of as follows, to wit; pay to my SON NATHANIEL R. TERRY, one fourth part,
to my DAUGHTER LORETTA TUTTLE WIFE OF PETER H. TUTTLE one fourth part,
to my DAUGHTER SARAH TERRY one fourth part, and the remaining
fourth part thereof I give and bequeath to the four living
children of my son JOHN H. TERRY decd. of the State of Georgia,
and to the survivors or suvivors of them, bu should all of the
said four children of my said son John H. Terry died before arriving
at the age of twenty one years, then and in that case it is my will
that all I have bequeathed to them in his my last will and
testament, go to, and be paid over to my three children above
named, to wit: Nathaniel R. , Loretta, and Sarah, share and share
alike, and I do hereby will and direct that the whole of the
money arising under or by virtue of this my last will to the said four
children of my said deceased son John H. Terry, remain in the
hands of my son Nathaniel R. Terry during the minority--
of the said four children, and that he settle with, and pay over to
them each as they shall arrive at the age of twenty one years and
should they all die without either of them arriving at that
age, then that he divide the money as above directed.
And lastly, I do hereby constitute and appoint my beloved wife
Elizabeth J. Terry and my son Nathaniel R. Terry executrix and
executor of this my last will and testament. In witness whereof
I have hereunto set my hand and seal this 1st day of Aug AD 1873.

is the executor named therein.

consisting of 2 cows, 12 calves, 8 or 10 hogs and pigs, Household & Kitchen furniture,
Farming tools, wagins, & 307 acres of land more or less
is worth about $2000.00 so far as can be ascertained at the date of this application; and that

ca 1800 - William Clayton is mentioned in his father's will written 16 Aug 180l. Oral tradition in the Clayton family states that one of the Clayton boys committed a murder in early 1800 and left the state. It is believed that it is this William Clayton, as he later turns up in Henry County, Tenn. Research has begun to find documentation about this murder. 48

Mar 1817 - Inventory of the estate of Ruth Clayton received by Joseph Winston, guardian -one negro boy price $300.00 which is hired out until 7 Jan 1818 for the sum of $59.96. Also 200 acres of land on Little Snow Creek with no improvements. This was all that Joseph Winston, guardian of Ruth Clayton did receive.

Mar 1818- Joseph Winston appointed guardian to Ruthy(Ruth) Clayton.

Mar 1818 - Joseph Winston guardian of Ruth Clayton report the following amount of property. On 1 Jan 1818 a note in the hands of John G. Smith for the hire of a negro boy $84.00; money in the hands of F. J. Smith $38.80; cash received $5.28; buy a pair of shoes for boy Abraham at $1.31; same for self at $1.62. The total remaining in the hands of $125.80 the guardian submitted. Signed by Andrew Bowman.

On 4 Oct 1820 when Ruth was 24, she married Levi CLINKSCALES51, 4033, M, son of William CLINKSCALES, 16258, M (1760-1845) & Nancy COLBERT, 16259, F (1768-1850), in Stokes Co.,NC. Born ca 1795 in Virginia. Levi died in Carroll Co., Mo. on 13 Feb 1839; he was 44.
