In the name of God Amen, I John Garner of the
State of North Carolina Surry County
being of sound and perfect mind and memory bless
be to God do this eighth day of October in the year our
Lord one thousand eight hundred forty seven
make ordain and publish this my last will & testament
in manner and form as follow that is to say
I give and bequeath unto my beloved wife Amy
Garner the tract of Land on which I now live containing
56 acres with all the improvements thereon and after
the death of my wife or intermarring with another
man then it is my will and desire that my son
William Garner shall have the aforesaid tracts of
land free and clear of all manner of claims whatsoever
I also give to my wife Amy Garner one choice
horse and saddle one choice bed furniture & clothing
sufficient for the same, one choice cow as her own
right and property.
2nd I give and bequeath to my daughter Lydia Garner
one bed bedstead and furniture, I also give to my
two sons William Garner and Francis Garner one bed
bedstead and furniture each and all the remainder
of my personal property I give to my wife Amy
Garner so long as she shall live my widow and
after the death or Intermarring of my wife with another
man, then it is my will that it shall be sold
and the money arising therefore to be divided as
follows: first I wish my daughter Lydia to have
fifty dollars, and the balance equally divided
between my Children William Garner, Francis Garner
and Lydia Garner.
I think that I have money enough owing to me
to pay all my just debts, which I wish my Executor
who is hereinafter named to collect and apply
accordingly and if there should be any surplus
there to be paid to interest by my executor my daughter
Lydia Garner shall arrive to the age of twenty one years
and then to be equally divided between my Children
William Garner, Francis Garner and Lydia Garner.
3rd I give and bequeath to my son Francis Garner
my tract of land know by the name of
Clingman Tracts supposed be contain 200 acres
of land.
I also give to my son William Garner one hundred
acres of land to be taken off the Henry E. Garner
tracts by running a line north & south as is to that
line one hundred acres on the west side of said
tract and the remaining part of said tract of
land I give to my daughter Lydia Garner and
further it is my will that my wife Amy Garner
remain in possession and enjoy the benefits rents &
profits of all the above mentioned Land entitled
my children William, Francis and Lydia shall arrive
or attain the age of Twenty one years.
And I do hereby make and ordain my worthy friend
T. C. Hauser and my wife Amy Garner my Executor
and Executrix to this my last will and Testament
let my hand and seal the day and year above
