William R. Doss, Thos. E. Snow & wife, Amy, Sion Wood, Ira Wood and William
R. Wood, plffs
vs
William Stanly, Nancy Stanly, Mildred Stanley defts.
To the Clerk of the Surperior Court of said County:
The petition of William R. Doss, Thos.E. Snow and wife Amy, Sion Wood,Ira Wood and William R. Wood would respectfully show that William Stanly died intestate in the County of Surry about the year 1870[1880] seized in fee simple of a tract of land in said County containing about two hundred and fifty acres adjoining the lands of William Doss Wesley Whitaker and others and leaving him suviving Margaret Wood William Stanley, Sallie Wood, Nancy Stanley, Mildred Stanley his children and heirs.
That your petitoners William R. Doss has since purchased for a valuable consideration all the right, title and interest of Sallie Wood and her husband Lee Wood to the Said Land and too a deed in fee simple which said
deed was duly registered in the office of the Register of Deeds for said County.
That Margaret Wood one of the children and heirs of the said [died] intestate and
in the County of Surry about the year 188_[blank] leaving as her heirs Your pe-
titioners, Sion Wood, Ira Wood,William R. Wood and Amy Wood who intermarried with Thos. E. Snow that John Brown known as administrator upon the estate of William Stanley sold under order of the Superior Court of said County to pay debts of intestate, Wm. Stanly one hundred and twenty five acres of said land and at other time
sixty two and a half acres for likewise purpose.
That the Parties plantiff and defendant to this action are tenants in common of the remaining sixty two and a half acres which adjoins the lands of Wm. R. Doss Harden Brown, the lands of the late Riley Wood and others and in which William R. Doss, William Stanly,Mildred Stanly and Nancy Stanly own each a one fifth interest and Sion
Wood, Ira Wood, William R. Wood and Thos. E. Snow and wife Amy own each
a one twentieth interest.
Your petitioners further show that they desire partition made amongst the parties in interest, but owing to the surrender of parties interested and the smallness of the shares, especially the shares of Margaret Woods heirs, your petitioners think it is impossible to have actual partition of said land without injury to the parties interested.
Therefore your petitioners ask that a commissioner be appointed to see the said land upon such terms as to the Court may seem most advantageous and that the proceeds of said sale be divided among the parties to this action according to their respective shares as hereinafter before set forth.

of the same and they also admit the fact that Margaret Wood William Stanley Sallie Wood Nancy Stanley & Mildred Stanley were his surviving children and heirs at law.
That as to that part of the petition which alleges that William R. Doss has purchasd the interest of Sallie Wood and her husband Lee Wood in said Lands Defendants know nothing of the truth thereof. Snow and wife Amy are owners in right of their mother Margaret Wood of other fifth that said parties take said land per steepes(sic) and not per Captita and that therefore said land should only be divided into five equal parts and that there is no good reason why said land should not be actually divided.
Relief:
Therefore the defendants above named would respectivefully ask that said land be actually partitioned and to that end that the Court appoint three good and lawful men
who shall make an actual partition as set forth in this answer and that if necessary the more valuable dividens be charged with such sums of money as may be necessary to make their shares equal. T. W. Folger Atty
